Use of the services offered on the https://convrt89.com/ (hereinafter referred to as "the Site") implies full and entire acceptance of these General Terms and Conditions of Sale (hereinafter referred to as "Conditions") by users (hereinafter referred to as the "Customer"). These Conditions govern the contractual relationship between JMM PUBLISHING LTD (the "Seller") and the Customer.
The version of these Terms currently published on the Site is the only version to prevail throughout the period of use until a new version is put in place.
The Seller may revise these Conditions at any time, updating them as necessary for regulatory or operational compliance. Customers are advised to consult this page regularly. Acceptance of the revised Terms is required to continue to use the Site following any changes.
Article 1 - Glossary
For the purposes of these Conditions, the following definitions shall apply:
- "Subscription means a periodic commitment by the Customer to access the services offered by the Site.
- "Customer means any individual or entity purchasing services on the Site.
- "Customer Account is the space dedicated to the Customer on the Site, enabling them to manage the services they have subscribed to.
- "General Terms and Conditions of Sale or "Conditions" means this contractual document.
- "Order represents the purchase commitment made by the Customer on the Site.
- "Services include the services available for purchase on the Site.
- "Site refers to the website operated by the Seller, accessible mainly at the address https://convrt89.com/.
- "User is any person who accesses the Site, without necessarily making a purchase.
The terms "Customer", "User" and "Seller" may be used interchangeably in the remainder of this document to designate the parties concerned.
Article 2 - Presentation of services
### 2.1 General information
The Services offered for sale on the Site are described and presented as accurately as possible. However, the Seller cannot guarantee perfect similarity with the final product, particularly as regards images.
### 2.2 Contractual prerequisites
The Customer acknowledges that he/she has read the Terms and Conditions before purchasing and confirms his/her agreement by ticking the appropriate box before proceeding with the online ordering procedure, as well as the terms of payment.
### 2.3 Purpose of Services
The Customer may subscribe to various Services, the specifics of which are detailed on the Site. These Services may include access to exclusive digital content, personalised services or specific offers.
### 2.4 Subscription Conditions
The process of subscribing to a Service begins with the completion of the order form and ends with payment for the chosen Service. All the steps required for the sale and all the contractual information will be confirmed in good time before the order is finalised.
Article 3 - Order process
### How to Place an Order
To purchase a Service, the User must select the Service of their choice, add it to their basket and proceed to payment. Before validating the order, the Customer must accept these Terms and Conditions, choose the delivery address and method, and finally validate the payment method.
#### 3.1 Selecting Services
After choosing the services, the Customer confirms all the features and the total price (including taxes and other applicable charges).
#### 3.2 Final Validation
Before submitting their order, Customers may check the details of their order and its total price, and return to the previous pages to correct any errors or modify their order. Confirmation of the order will result in the formation of the contract and will be final.
Article 4 - Financial arrangements
#### 4.1 Prices
The Services are provided at the current prices shown on the Site when the order is registered by the Seller. Prices are expressed in Euros, inclusive of tax.
#### 4.2 Terms of Payment
Payment is due immediately upon ordering, including for pre-ordered products. The Customer may pay by credit card or by any other means offered by the Site.
#### 4.3 Payment Security
The Site uses a secure payment solution that complies with PCI DSS security standards. The Seller does not store any of the Customer's banking information.
Article 5 - Right of withdrawal and return policy
#### 5.1 Right of Withdrawal
In accordance with current legislation, Customers have the right to cancel their order within 14 days of subscribing to the service, without having to justify their decision or pay any penalty.
#### 5.2 Exercising the right of withdrawal
To exercise the right of withdrawal, the Customer must notify his decision to withdraw from this contract by means of an unambiguous statement. They may use the model withdrawal form, but this is not compulsory.
#### 5.3 Effects of withdrawal
In the event of withdrawal by the Customer, all payments received from the Customer will be reimbursed, including delivery costs (with the exception of additional costs arising from the fact that the Customer has chosen, where applicable, a delivery method other than the less expensive standard delivery method offered by the Vendor).
Article 6 - Obligations of the Seller
#### 6.1 Provision of the service
The Seller undertakes to provide the Service ordered via the Site in accordance with the terms of these Conditions.
#### 6.2 Legal warranties
Irrespective of any commercial warranty that may be offered, the Seller remains liable for any lack of conformity of the service and any redhibitory defects in accordance with the legal provisions in force.
Article 7 - Seller's liability
The Vendor declines all responsibility in the event of non-execution or poor execution of the contractual obligations attributable either to the consumer, or to the insurmountable and unforeseeable act of a third party to the contract, or to force majeure.
Article 8 - Personal data
The Seller collects and processes the personal data of its Customers in accordance with the law on the protection of personal data in force and described in the Site's confidentiality policy.
Article 9 - Intellectual property
The contents of the Site, including texts, graphics, logos, sounds, images and videos are the exclusive property of the Seller and are protected by copyright and other intellectual property rights. Any total or partial reproduction of this content is strictly prohibited and may constitute an infringement of copyright.
Article 10 - Applicable law and jurisdiction clause
These General Terms and Conditions of Sale and the transactions arising from them are governed by and subject to English law. Any dispute relating to their interpretation and/or performance shall be referred to the English courts.
